AMP Sport Inc., a division Information Growth Strategies, Ltd., (“AMP”) has created this Privacy Policy (“Privacy Policy”) to demonstrate its commitment to fully disclosing the information collection and use practices applicable to the website, the related AMPSport mobile application, and to any other websites or apps maintained by AMP in connection with its AMP software service (collectively, the “Services”).

By using or accessing the Services, you signify your acceptance of the terms of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please exit the Site immediately, uninstall the App from your electronic device, and/or otherwise discontinue all use of the Services.

1. Types of Information and Method of Collection

General Information Collection

    • By Browsing. As you browse the Site the Internet protocol (IP) address of your computing device, “cookies” (described below) and other standard tracking data AMP uses to evaluate Site traffic and other usage patterns pertaining to the Services are collected. Such information is aggregated with tracking data from all Site visitors. If you only browse this Site, but do not become a member you are not required to identify yourself or provide any personally identifiable information. For purposes of this Privacy Policy, the term “Personally Identifiable Information” refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains.

    • By Requirement. To register as a member of this Site, and to use some features of the Services, you are required to provide the following Personally Identifiable Information: your name, your address, a user name that you create and a personal, active e-mail address.

  • By User’s Voluntary Submission. When using the chat room, forum and message board features available through the Services, you may choose to provide other Personally Identifiable Information. If you post Personally Identifiable Information anywhere using the Services, it will be available to third parties and you may receive unsolicited messages from those parties. AMP has no obligation to ensure the security or confidentiality of any information you choose to make available in any chat room, blog, forum or message board using the Services. Also, AMP cannot ensure that parties who have access to such information will respect your privacy. Please exercise caution when deciding to disclose Personally Identifiable Information.

The Site uses a feature of your web browsing application (“browser”) to set “cookies” on your computing device. Cookies are small packets of information sent by the Site through your browser to your computing device. AMP uses cookies to save your password so you do not have to re-enter it each time you visit the Site. These cookies can be deleted or modified through your browser settings. If you do not want your browser to accept cookies, you can turn off the cookie acceptance option in your browser’s settings. You may modify your browser preferences to provide you with choices relating to cookies. You have the choice to accept all cookies, to be notified when a cookie is set or to reject all cookies. If you choose to reject cookies you may be unable to use those AMP services that require registration in order to participate, will have to sign in each time you visit the Site, or may not be able to utilize fully all of the Site’s features and information.

Information on Children

AMP does not knowingly collect information from children under the age of 13. On-line registration and usage of the Services is intended for athletes, coaches and other individuals who are engaged in the sports field or industry. If AMP learns that it has Personally Identifiable Information on a child under the age of 13, AMP will delete that information from its systems. AMP encourages parents and guardians to monitor children’s online usage. Parental control protections, such as computer hardware, software or filtering services, are commercially available to limit the access to material that is harmful to minors.

2. How Information Collected is Used

Subject to any AMP™ Saas Agreement in place relating to the Services, which governs ownership and use of User Data, the information collected by and through the Services is owned solely by AMP. The information collected by and through the Services may be used by AMP, its divisions, subsidiaries, and affiliates, or other entities that are involved in the operation of the Services for AMP’s purposes.

AMP may use the information collected, individually or in an aggregate form, as follows:

    • to contact you about the Services;

    • to compare and otherwise use data entered by users, including athlete profiles, for any purpose including consulting, research and marketing;

    • to evaluate products and services AMP or third parties could offer to you;

    • to monitor or improve use of the Services;

    • to customize the advertising and content you see when you use the Services;

    • to monitor compliance with AMP’s Terms of Use Agreement governing the Services;

    • to provide special offers to you from AMP and/or its affiliates and subsidiaries and other third parties; and

    • to send you promotional material on behalf of AMP and/or its affiliates and subsidiaries and other third parties.

3. With Whom Information is Shared

At times, we may share the information collected through the Services with third parties for various purposes. While AMP will seek to require those third parties to follow appropriate privacy policies and security measures, AMP does not bear responsibility for any actions or policies of third parties. The following outlines the ways in which your information may be shared with others:

User Data: We may share information you provide, including, but not limited to, athlete profiles, schedules and data sets with third parties for any purpose. However, AMP will not, without your prior permission, share such information in a form that allows other members or third parties to link it to any Personally Identifiable Information.

Promotional Offers:Our third party partners and sponsors may use your user name to contact you through the Services with special offers or promotional material. We will not provide third party partners or sponsors with any of the Personally Identifiable Information you provide to AMP when you register as a member on the Site. Any Personally Identifiable Information that you post voluntarily in a chat room, blog, forum, or message board using the Services may be accessed by third parties. We are not responsible for the privacy practices of third parties, and you should review the privacy practices of such third parties prior to providing any of your Personally Identifiable Information to them. If you do not want to receive special offers or promotional materials from AMP or third parties, you may either “opt-out” during the registration process, change your user preferences later on, or contact AMP by using the contact information provided in Section 8, below.

Aggregate Information:We may share aggregate information, such as general demographics and Site usage statistics to third party advertisers, sponsors or other organizations. The general demographic information may include how many athletes, coaches or other users are registered as members on the Site. We do not share specific demographic information, such as users’ ages or addresses. When general demographic information is shared with third parties, we do not provide them with the Personally Identifiable Information that you provide to AMP when you register as a member on the Site.

AMP Subsidiaries and Affiliates:We may share your Personally Identifiable Information with employees, agents, parents, subsidiaries, and affiliates of AMP.

Business Transfers: The Services, AMP and/or a subsidiary or division of AMP may be sold along with its assets, or other transactions may occur in which your Personally Identifiable Information is one of the business assets transferred. In such a case, your Personally Identifiable Information, which we have gathered, may be one of the business assets we transfer.

Legal Process: AMP reserves the right to disclose the information collected by and through the Services, including your Personally Identifiable Information, as required by law and when AMP believes that such disclosure is necessary to protect AMP’s rights and/or comply with a judicial proceeding, subpoena, court order or other legal process served on AMP. The disclosure of this information may be without notice to you.

4. Security and Encryption

While there is no such thing as “perfect security” on the Internet, AMP takes commercially reasonable precautions to protect the Personally Identifiable Information that you provide to AMP when you register as a member on the Site. We use SSL encryption technology and a secure server to encrypt information transmitted between your browsers and our server. As a result, Personally Identifiable Information that you submit during the registration process is transmitted using commercially reasonable security over the Internet.

Our security policies are reviewed periodically and revised as required. The servers that contain Personally Identifiable Information are stored in a physically secure and climate controlled off-site facility. We protect against data loss by backing-up data, performing, consistency checks and restricting access to information on our servers. It is important to remember that whatever you transmit or disclose online can be collected and used by others or unlawfully intercepted by third parties. No data transmission over the Internet can be 100% secure.

5. Third Party Links, Websites, and Cookies

The Services may contain external links to third party websites. We have no control over, and are not responsible for, the content of, or information gathered by these other websites. Any Personally Identifiable Information collected by such third parties is subject to such third parties’ privacy policy. Companies that advertise through our Services do not have access to Personally Identifiable Information that you do not post in chat rooms, blogs, forums, or message boards on the Site or to our cookies on the Site. Those advertisers may themselves set and access their own cookies on your computing device if you choose to have cookies enabled in your browser and you access their websites. Third parties’ use of cookies is subject to their own privacy policies.

6. Notification of Changes

AMP reserves the right, at any time and without notice, to add to, change, update or modify this Privacy Policy simply by posting such change, update or modification through the Services. Any such change, update or modification will be effective immediately upon posting. If at any point AMP decides to use Personally Identifiable Information in a manner different from that stated at the time it was collected, we may notify you by way of an e-mail or some other means. Your continued use of the Services shall constitute your acceptance of such revised Privacy Policy. Since this Privacy Policy may change from time to time, you should review it periodically before you provide any additional Personally Identifiable Information anywhere using the Services.

7. Corrections and Updates to Personal Profile

You have the option of reviewing, correcting, updating, modifying, and deleting your Personally Identifiable Information or member profile, at any time and as often as desired by personally changing your profile information or by contacting AMP by telephone, facsimile, e-mail, or mail by using the contact information in Section 8, below. However, you must always have an active, personal e-mail address registered on the Site.

To the extent that such information is stored in other databases, we cannot always ensure that such corrections or deletions will reach the other databases. We will use all reasonable efforts to ensure that your information is removed from or corrected in our records.
